Welcome to Automation Blueprint™ (“AB”, “we”, “us”, or “our”). By using our Services—including our website, software, coaching, and digital tools—you agree to the following legally binding Terms of Service (“Terms”). If you do not agree to these Terms, please discontinue use of the Services.
1. WHO WE ARE
Automation Blueprint LLC is a North Carolina–registered Limited Liability Company providing digital consulting, automation software, education, and tech platform services to entrepreneurs and small businesses.
2. ELIGIBILITY
You must be at least 18 years old and legally able to enter into a binding agreement to use our Services.
3. ACCOUNTS & SECURITY
You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity under your account. Notify us immediately of unauthorized use.
4. SUBSCRIPTIONS, PAYMENTS & FEES
• Subscription Terms: Services are provided on a pre-paid subscription basis (monthly or annual), with access continuing through the paid period.
• Auto-Renewal: Subscriptions auto-renew unless canceled in advance.
• No Refunds: We do not offer refunds for any reason—including non-use, platform misuse, bot attacks, service interruptions, or rising third-party fees.
• Chargebacks: Chargebacks are treated as payment disputes and may result in immediate suspension. We reserve the right to collect the original amount, plus recovery costs.
• Separate Communication Costs: Your subscription covers platform access only. Communication tools (e.g., SMS, phone calls, emails) are billed separately based on usage. Current rates are available on our Pricing Page.
• Late Fees: Late or failed payments may incur penalties, interest, or service suspension.
• PCI Compliance: Payment data is handled securely through our payment processor (e.g., Stripe). We do not store your card data directly and follow PCI DSS best practices.
5. LICENSE & OWNERSHIP
You are granted a limited, non-exclusive, non-transferable license to use the platform for your business.
• No transfer of accounts: You may not resell, share, or move your Automation Blueprint account outside the AB ecosystem.
• Intellectual Property: All funnels, automations, templates, and content provided remain the intellectual property of AB.
6. SERVICE AVAILABILITY & LIMITATIONS
We strive for reliability but do not guarantee uninterrupted service. We are not liable for:
• Platform outages, bugs, or delays
• API failures or third-party issues
• Bot attacks or fake leads
• Loss of revenue, data, or business
7. USER CONTENT & CONDUCT
If you post or submit any content (e.g., reviews, comments, messages):
• You retain ownership but grant AB a worldwide license to use, display, and share it as needed to operate our Services.
• You may not post offensive, defamatory, unlawful, or misleading material.
• We reserve the right to remove content or restrict access for violations.
8. THIRD-PARTY SERVICES
AB integrates with third-party tools like Twilio, Mailgun, Cloudflare, The Marketer's Toolkit, HL Pro Tools, Stripe, Google, etc. These services are governed by their own terms. We are not liable for their changes, outages, or actions.
9. FTC COMPLIANCE & EMAIL/SMS RESPONSIBILITY
You are responsible for complying with:
• CAN-SPAM, TCPA, CASL, FTC guidelines
• Obtaining valid opt-in consent
• Honoring unsubscribe requests promptly Violation may result in suspension or termination.
10. USER COMMENTS & CONTRIBUTIONS
Parts of our platform may allow you to post comments, feedback, or other user-generated content. You agree that:
• You have the right to post the content and it does not infringe any third-party rights.
• Your content does not contain defamatory, abusive, or illegal material.
• We may use, modify, or remove your content at any time, at our discretion.
We do not pre-screen content but reserve the right to monitor and remove anything that violates our policies or applicable laws.
11. COOKIES
We use cookies and similar tracking technologies to enhance your experience and analyze site traffic. By using our Services, you consent to the use of cookies as described in our Privacy Policy. You may disable cookies in your browser settings, but doing so may affect the functionality of our Services.
12. PRIVACY POLICY
Our Privacy Policy outlines how we collect, store, and use personal information. By using our Services, you also agree to our Privacy Policy.
13. Data Security & Retention
We use industry-standard protections to secure data. No system is 100% secure. Data is retained as long as necessary to fulfill legal, operational, or compliance needs. You are responsible for managing access to your account and safeguarding any client data you store within the platform.
14. INDEMNITY
You agree to indemnify and hold harmless Automation Blueprint LLC and its team from any claim or liability arising out of:
• Your use of the platform
• Your communications or contact list
• Your breach of these Terms or any law
This includes any legal fees incurred.
15. LIMITATION OF LIABILITY
To the maximum extent allowed by law, we are not liable for any:
• Indirect, incidental, or consequential damages
• Loss of income, business opportunity, or goodwill
• Data loss, platform errors, or delays
• Acts of third parties, vendors, or automated bots
Our total liability under these Terms is capped at the total amount paid to us in the prior 3 months. Exception: Nothing in this section limits or excludes liability for fraud, willful misconduct, or gross negligence where such limitation is prohibited by law.
16. DISCLAIMER
To the fullest extent permitted by law:
• Our Services and website are provided “as is” and “as available” without warranties.
• We do not guarantee uptime, accuracy, or completeness.
• We are not liable for any damages resulting from your use of the website or platform, including loss of income, data, or business opportunities.
Nothing in this disclaimer limits liability for death, personal injury, fraud, or anything else not legally excludable.
17. TERMINATION
We reserve the right to suspend or terminate your account at any time for violating these Terms.
• You may cancel your subscription anytime. No refunds are provided.
• Upon cancellation or termination, your access will end at the close of the current paid period.
• You may export your contacts prior to account closure.
18. HYPERLINKING
The following may link to our website without prior approval:
• Government agencies
• Search engines
• News outlets
• Online directories listing us
Others (e.g., .orgs, industry blogs) may request permission to link. All links must be non-deceptive, non-defamatory, and consistent with our brand.
We reserve the right to request removal of any link at our discretion.
19. IFRAMES
You may not frame our site or any content in a way that alters its appearance or misrepresents our brand without prior written permission.
20. CONTENT LIABILITY
You agree not to display links to our Services on sites that are unlawful, obscene, defamatory, or violate third-party rights. We are not liable for content that appears on any third-party site linking to us.
21. Force Majeure
Automation Blueprint LLC shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, labor disputes, pandemics, cyberattacks, outages of third-party service providers, utility failures, or governmental actions. Such circumstances shall not constitute a breach of this agreement.
22. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
23. GOVERNING LAW
These Terms are governed by the laws of the State of North Carolina, USA.
24. DISPUTE RESOLUTION & ARBITRATION
• Binding Arbitration: Any dispute arising from these Terms shall be resolved by confidential binding arbitration in North Carolina, under American Arbitration Association rules.
• No Class Actions: You waive the right to join a class action or seek jury trial.
• Each party bears its own legal fees unless the arbitrator awards otherwise.
25. MODIFICATIONS
We may update these Terms from time to time. Continued use after updates constitutes acceptance of the new Terms.
